Terms of Service

These terms govern use of TalkToMe, a software-as-a-service (SaaS) offering provided by Rwandeka LTD ("we", "us"). By using the platform or creating an account, you confirm that you have read and accepted these terms on behalf of the business you represent.

1. Service provider

The service is provided by Rwandeka LTD, the owner and operator of TalkToMe.

2. Service description

TalkToMe is a multi-tenant SaaS platform that helps businesses connect their own communication channels — including the company's own WhatsApp Business account through supported integrations — and receive, manage and reply to customer conversations, with AI assistance for customer-service teams and business workflows configured by the customer through the platform. Available channels and features vary by account settings, plan and availability for each business, and we may add, change or discontinue features over time.

3. Customer responsibilities

  • Provide accurate and up-to-date information when registering and using the service.
  • Keep sign-in credentials and authorised user accounts within your organisation confidential.
  • Use the platform in compliance with applicable laws in your jurisdiction.
  • Ensure that you own or administer the channels and accounts you connect, and that you hold the necessary consents from your customers where required.
  • Supervise content sent to your customers through the platform, and review automated replies where used.
  • Notify us promptly of any unauthorised use of your account.

4. Authorisation to connect third-party accounts

When a customer connects an external account or channel (such as a WhatsApp Business account), it grants us the authorisation needed to access that account and use its data to the extent required to provide the service, and that authorisation remains revocable by the customer. The customer is responsible for having the legal authority to connect that account. Use of the external platform is also subject to its provider's terms and policies.

5. Acceptable use

You may not use the platform for any unlawful purpose, including sending unsolicited or misleading messages, impersonating others, infringing intellectual property rights, attempting unauthorised access to platform systems or other customers' data, disrupting or abusing the service, or transmitting harmful or inappropriate content.

6. Third-party services and platforms

Some features depend on third-party platforms and service providers. The service may be affected by changes made by those providers (such as changes to their APIs, policies or availability), and we do not control the continuity of those external services.

7. Availability and service changes

We aim to provide a stable service, but the service may be subject to maintenance windows, interruptions and updates. We may modify the service, add features or discontinue features, with appropriate notice where a change materially affects the customer's use of the service.

8. Data and privacy

We handle data in accordance with our Privacy Policy, which forms part of these terms. The customer remains responsible for its data and for the content of its conversations with its customers.

9. Intellectual property

All rights in the platform, its software, design and trademarks remain with us or our licensors. These terms do not grant the customer any ownership interest in the platform, only a limited, non-transferable right to use it in accordance with these terms and for the subscription term. The customer's own data and content remain theirs.

10. Suspension and termination

We may suspend or terminate access to the service in the event of a material breach of these terms, unlawful use, or violation of our policies, with notice to the customer where practicable. The customer may stop using the service or close its account, subject to obligations accrued before termination and to the retention principles set out in the Privacy Policy.

11. Limitation

The service is provided on an "as is" and "as available" basis. We do not warrant that the service will be uninterrupted or error-free, or that it will meet every requirement of a particular business. To the extent permitted by applicable law, we are not liable for indirect, consequential or incidental damages, or for lost profits or data arising from the use of, or inability to use, the service. Nothing here affects any liability that cannot lawfully be excluded.

12. Changes to these terms

We may update these terms from time to time. The updated version will be published on this page with a revised "last updated" date, and continued use of the service after publication constitutes acceptance of the updated terms.
